David Smith, Partner at JMW Solicitors and a recognised legal expert in property litigation and regulatory affairs, will present a masterclass this Friday morning in partnership with Fixflo.
Titled Important Updates to Possession Claims in the Private Rented Sector, the learning session will deep-dive into recent legal changes surrounding possession claims and their implications for current and future possession proceedings.
Under the spotlight will be the Court of Appeal’s ruling in the case of Trecarrell House Limited v Rouncefield.
David had supported the landlord’s claim during his tenure as Policy Director of the Residential Landlords Association.
The case is expected to set precedent and finally put to bed the debate on a section 21 notice’s validity when the tenant is provided with a gas safety certificate after they move in and before they are served a section 21 possession notice.
Ruling on the case is scheduled to be released on Thursday 18th June and attendees to Friday’s masterclass will be one of the first to learn about the court’s decision and what the case law will be on future possession claims.
Other topics to be discussed are the new Pre-Action Protocol for private renting and the Coronavirus Act 2020.
Attendees will have an opportunity to ask questions live.
