Another agent in cartel case gives undertaking not to act as director

The long fall-out from the Burnham-on-Sea estate agency cartel case continues, with one of the agents now undertaking not to act as a director of any UK company for five years.

The Competition and Markets Authority has accepted the undertaking from Graham Thompson, former director of Saxons PS Ltd.

As a result of the undertaking, a claim in the High Court against Thompson seeking his disqualification will not proceed.

The CMA said it is pursuing proceedings against Michael Martin, formerly a director of Gary Berryman Estate Agents, The Property Group (2010) and Warne Investments.

Proceedings against both directors arose from the CMA’s decision on May 31, 2017, that Gary Berryman Estate Agents, Warne Investments and Saxons PS together with four other estate agents entered into an anti-competitive agreement to fix commission fees at 1.5%.

Two other directors, David Baker and Julian Frost, both formerly of Abbott and Frost, gave undertakings in April last year not to act as directors, for three years and six months, and three years respectively.

Altogether the Burnham-on-Sea affair resulted in five agents being fined over £370,000.
