Rogue landlord fined and given suspended jail term for putting tenants lives at risk

A landlord has been given a suspended sentence of 26 weeks and electronically tagged for four months after putting the lives of her tenants at risk by not maintaining gas appliances at a property in Kent.

Dawn Holliday, 62, refused to undertake gas safety checks even after the Health and Safety Executive (HSE) took enforcement action against her.

Holliday claimed to have no money for undertaking maintenance to the property, leaving the tenants with a very temperamental boiler that banged and often left the occupiers with no heating or hot water, as well as a condemned cooker for several years.

However, an HSE investigation found that Holliday was receiving full rent from the tenant for the property on First Avenue in Eastchurch, when the enforcement action was taken.

Despite the Improvement Notice served on Holliday to undertake gas safety checks, she ignored this and further requests from HSE. She also claimed the tenants had moved out and had not been paying rent, the investigation found this claim to be completely untrue.

At Sevenoaks Magistrates Court this week, Dawn Holliday, of Golden Leas Holiday Park, Plough Road, Minster on Sea, pleaded guilty to three charges under Health and Safety at Work etc Act 1974 Section 21 and Gas Safety (Installation & Use) 1998 36(2) and 36(3) and was sentenced to imprisonment of 26 weeks, suspended for a period of 12 months, District Judge Leake also imposed an electronically monitored curfew on Holliday at her address for a period of 4 months with the curfew hours of 20:00-06:00 and awarded HSE £750 in costs.

Additionally the Judge made a remediation order pursuant to section 42 of the 1974, for Ms Holliday to undertake the gas safety inspection required of her by the 6th December 2024.

The prosecution was brought by HSE Enforcement Lawyer, Samantha Wells, assisted by paralegal Imogen Isaacs.

Speaking after the hearing, HSE Inspector Joanne Williams said: “We are dedicated to ensuring that landlords operate within the law and provide safe accommodation for tenants.”

“We do not tolerate disregard for health and safety and consider the non-compliance of HSE enforcement notices as a serious offence.

“In this case Ms Holliday chose to flagrantly ignore the support, guidance and warnings from HSE to assist her in compliance with the law and continued placing her tenants at serious risk of injury or even death.

“Wherever possible we will continue to work with landlords to improve health and safety. However, we will not hesitate to take enforcement action where necessary and prosecute individuals who ignore warnings and the law.”

    I would be intrigued to see what would happen if the tenant refused access for a gas safety certificate or other work, and there was no key to allow a contractor and Landlord to enter with notice given in advance… Obviously this landlord deserves her punishment, which is quite light considering, but I would be curious how the Court would either deal with a landlord taking them to court, or trying to serve notice with no valid GSC because the tenant wouldn’t let them in…

        No, this landlord pled guilty and the tenants paid the rent, according to the article. I’m asking about a hypothetical situation where a paying tenant refused access for a gas certificate or required work. Would a Court still grant possession if there was not a valid certificate, would they prosecute the landlord/agent who has made every effort to comply with the law but been unable to do so?

    Giving a very bad and rare impression of Landlords, justly deserved the sentence, However, I struggle to see significance or relevance of a Tagged curfew. If she was a night-time predator, burglar etc, then yes ?
    Barmy decision by our crazy judicial system.

      Even with a breach of the peace police officer I was not allowed in my property.

        The rent has not been paid for over a year. The main gas tank was disconnected by the tenants partner after gas was delivered and not paid for. There was I wire in the meter so they did not pay for electric. My supply was changed when they got caught. The buisness in the garage had over 200 fish tanks in. They bred dogs,chickens,***** and doves at the property. The tenants partner fitted my new boiler saying he was gas safe,?? They took out my water tank and sold it. I condemed the garage electrics as unsafe after 200 tanks were removed and wires cut?? They turned it back on. They have indoor extention leads running the length of my garden and claim the police told them too??
        This is all so wrong…

          She gives landlords a bad name, well deserved punishment in my opinion should have been prison, hopefully her tenants will bring a civil claim and make her realise greed doesn’t pay,as it states rent was paid in full but she wouldn’t pay for a simple thing like a gas safety check, really makes you wonder what else she hasn’t done to HER property

                  Reading the article again I can’t see anywhere that the rogue landlord was prosecuted for who fitted the boiler…she plead guilty to not carrying out her legal responsibilities as a landlord by not get annual gas safety inspection certificates.

                    The Tenant fitted the boiler claiming to be corgi registered. They also disconnected my mains gas tank and fitted small gas bottles themselves.

You’ve been prosecuted (and plead guilty)to your failures as a landlord, in the HSE article it says you was in court on Monday so my question is have you now carried out your gas safety inspection as it is now Friday ??

                      Even if a landlord didn’t check and ask to see proof of Corgi registered ( lets be honest, who does ? ) you would still be asking the Tenant for a Gas certificate, and if one wasn’t produced, any reasonable person would become suspicious ?

    Looking back on DawnH comments on here she needs to hope that her tenants or the HSE do not get wind of them because a simple report to the courts and probation service would lead to a breach of sentencing and contempt of court hearing and more than likely a custodial sentence as the courts do not like this behaviour (making a fool out of the judge) harassment towards the victims, I have seen sentences doubled and more over less than this.(for your information I am a solicitor)

      Sanjay The judge was aware why I plead guilty. I am not unhappy about my sentance either. The court has done what was needed. No one gets in trouble for having an opinion.
      I am entitled to stick up for myself.

        Could you elaborate on your comment “the judge was aware why I plead guilty” because that is suggesting a judge allowed someone that he knew is innocent to plead guilty and then gave them a high sentence and it is my belief that this is not how the uk judicial system works

        I will raise this issue with the JCIO this morning because I feel from what you have said , judge Leakes action have fallen short of what is expected from our system ,in your comment you are saying that the judge was “in on it” as far as your plea is concerned, so therefore did he give you a lenient sentence!!

    Clearly what the comments on this ‘ article ‘ reveal, is the dire inaccuracy of reporting on the case.
    Too often a one-sided report from the media appears on rental issues.

      From my understanding this is not a media report but an official press release from the investigating officer and the HSE, or have I missed something ?

        I have just been on the HSE website and as I thought this article is in fact there official press release regarding this case, so please can someone explain how they got it so wrong ? It would be very unusual for HSE to carry out an investigation and get everything so wrong, they are known for the attention to detail and not leaving any stone unturned, because of this they have a very successful prosecution rate in the uk

    Its quite simple in my eyes
    1) Did the landlord do her duties? Answer is No
    2) When the HSE got involved did she try and work with them? Answer is no
    3) Did the landlord plead Guilty or not guilty. answer is plead Guilty

    No matter what if the Tennent did say they was ‘Corgi Registered it was down to the landlord to check everything and get the correct paper work,. There has been an investigation by the HSE and By the landlords own admittance she has failed to do the basic test as a landlord, I dread to think what other failures she has done.

        she still has failed to answer if she has got a gas safety certificate. she quick enough to reply to try and defend herself but when questions are getting asked she’s not answering.
