Former employee takes Propertymark to employment tribunal

An employment tribunal in Birmingham is now into its second week.

It has been brought by a Miss C Jones against Propertymark.

She alleges unfair constructive dismissal and protected disclosure – or whistleblowing.

The tribunal sat four days last week and recommenced yesterday. It is due to sit again until Thursday this week.

Propertymark confirmed the tribunal is ongoing but did not comment.

So Christina worked within the disciplinary department for many years conducting most of the disciplinary panels If not all of them

She was targeted by Propertymark after standing up to them on regulation matters over allowing a number of corporate agencies get away with murder to encourage their membership.

this is all part of a coup by Chris Hamer who has taken over propertymark and turned in to a show with most recent people including mark Hayward retiring and david Viv applying for his job currently.

Let’s hope Christina is vindicated…. the fact that Propertymark took no action when Countrywide snaffled millions of client money to plug some holes in the sinking ship should be dealt with.
its time there was a bit more honesty about the organisation…. it purports to be a membership body but is really an aggressive business positioning itself to regulate the industry after a ****** battle with RICS… the members (and it would appear staff will just be viewed as collateral damage.

What a useless organisation. It’s become a personal fiefdom run by a few for a few. Does nothing for its members except provide a **** logo and equally **** brand that adds no value to anything. Leave!!

Hoping C Jones gets justice for the appalling way Propertymark treat not only their employees but their members too!  A toxic, bullyboy environment led my the smiling assassin, Chris Hamer and supported by his gofers, David Cox and Mark Haywood!  Your are an absolute disgrace to the property field.

I know Christina quite well and I regard her as a decent, honest, intelligent and straight talking person. I wish her all the very best with her claim. I won’t comment further on Christina’s story while the case is ongoing however, I will say that at the time I first became aware of her complaint, a number of Propertymark employees, past and, at the time, serving, contacted me about the work culture at Propertymark, claims of bullying by very senior people, along with some very serious concerns and allegations about large payoffs, NDAs’ and significant accountancy discrepancies. My own experiences and allegations about rule breaking and ‘activities’ of and by the board have been openly documented on these pages and in my blog.

Just a few of the serious questions that remain unanswered by Propertymark.

Email to Chris Hamer in 2017.

Dear Chris (Hamer – edited to add)

Thank you. The use of your wording appears very careful, brief and has avoided many of the perfectly reasonable questions previously posed. This is not the helpful, friendly, open, professional style of communication we enjoyed in the past during your time at TPOS. This is a pity on a number of levels but predominantly as it simply wastes more of our mutual time and raises further suspicions about the boards modus operandi and integrity.

Will you please confirm that, NAEA Propertymark, nor any of its subsidiaries received payment from Purplebricks (other than normal membership fees) for any engagements since trading as a private limited company or since as a PLC?
Will Propertymark please confirm that all current Purplebricks franchisee members have AML, ICO etc. or lawfully held these when their membership was renewed and will be required to have these on renewal?
Do Propertymark confirm or deny that one or more Purplebricks franchise members have been expelled or had their memberships terminated for noncompliance with AML, redress or ICO non-compliance?
Given that non-compliance in these matters is a criminal offence, were the appropriate organisations (HMRC/ ICO/ TPOS) Warwickshire TSOs’ and NTSEAT informed and what action resulted? If not, please explain why not?
Will Propertymark please confirm that it will adhere to any ruling or statement made by Warwickshire Trading Standards on estate agency/ related legislation as its primary authority?
Will Propertymark make a formal public statement reiterating the position and advice of its own compliance team, that of HMRC, TPOS etc. that any individual trading as a PPD of a business, including franchisees, must have AML or ICO and, that not doing so, is a criminal offence as defined and, call on Warwickshire Primary Authority to investigate and take action against individuals and companies that are currently trading as a PPD, registered with a redress scheme but not registered with ICO or HMRC?
In the alternate, will the board formally put on record that it agrees with the above statement or, a formal explanation of why it does not.
Please confirm who at Purplebricks PLC is the member listed with Propertymark as the PPD for that company as I wish to bring a formal and serious complaint against that company.

The following is an edited extract from an email received from BEIS.Gov.uk following my request for advice on a number of matters including Primary Authority status. The last line is of particular interest in terms of all professional bodies involved speaking as one in the interests of the consumer and the law but, should be read in conjunction with Warwick Primary Authority advice on a number of matters, not least of all pertaining to inaccurate marketing material in light of Purplebricks PLC being regularly found as using misleading advertising when denigrating competitors including NAEA members Link: http://propertymark.co.uk/media/1043187/how-to-legally-canvass-against-a-competitor.pdf

The National Federation of Property Professionals t/a Propertymark is a Co-ordinated Primary Authority partnership. It is a professional body encompassing membership divisions for estate agents, letting agents, commercial agents, valuers and auctioneers and inventory providers trading under the Propertymark branding. Also The Property Ombudsman Limited is a consumer redress scheme for the property sector. This is listed on the PA Register also. Primarily for assured primary authority advice for members of the association. To reduce conflicting advice and build consistency.

I look forward to Propertymarks formal response by return.

A law student I’m working with attended the tribunal as an observer yesterday and telephoned me to say she could not believe the behaviour of David Cox the MD of Propertymark
Despite Chris Hamer and David Cox failing to explain or respond to a range of allegations, and apparently admitting to many, David Cox begins shouting, arguing and talking across the tribunal judge and panel members We and the industry as a whole really need to be concerned when we have trade bodies and individuals like this leading and representing us These Individuals forget it is members hard-earned subscription payments that pay their wages Good luck to the lady making the claim – let’s hope it brings about some badly needed changes in personnel at Propertymark
It’s a 9 day tribunal and each of the management team has representation from Deminos, Propertymarks HR consultants – how much is this costing to defend this bunch?

If the above admission is true and on the record of the tribunal, I would be most grateful if your contact could email me via PIE, stating what was said and by whom. I firmly believe that along with the items I raised above, there are a number of other areas where I maintain that the NAEA/ NFoPP either failed to follow their own rules/ the law including the rigging of the Presidential Election process in 2017.

PIE published these stories at the time. https://propertyindustryeye.com/?s=naea+chris+wood+presidency

      Thank you.
