Two court proceedings involving Agents’ Mutual, and agents Gascoigne Halman, and Moginie James, are to be heard together.
This is the ruling in the Competition Appeal Tribunal, heard on Tuesday.
The ‘one other portal’ rule challenge now gets to another stage, this Friday at 4pm,
Further deadlines set by the court follow, in particular allowing Connells’ owned Gascoigne Halman permission to file a rejoinder by September 2.
However, many further deadlines are set in what looks to be a long running case.
A pre-trial review in respect of the competition issues is listed in the week starting December 12, with a time estimate of one day.
The actual trial of the competition issues is set to commence on February 3 next year and completed by February 20.
A spokesperson for OnTheMarket.com last night told EYE: “Agents’ Mutual has taken careful legal advice about key aspects of its strategy and its directors are satisfied that it is operating within the law.”

How naive of OTM to now find themselves boxed into this position over three acquisitions.
Is this really a battle with Connells?
